Hoping today goes by fast today. Thinking of you. Please have someone with you tomorrow when you are exchanging the kids, I would go as far as calling the police and asking them to just be there, this is something they will do if you let them know the circumstances. They would prefer to prevent something from happening then to have to come out after something has occurred. They'll just stand off to the side and not interfere at all unless he gets out of line. Please call your local police and arrange this.

I will see is a cop will come out and stay with me if not I will take a friend. I hope they are there! I wish I was like you all who enjoy the time away from kids, that was excruciating!

Avani I am hoping for the absolute best outcome this evening!

I think mom's who can value time away from their children (myself included) are in different circumstances and it does not completely mean that break comes from the bio dad.

GREAT IDEA ASKING THE POLICE TO COME OUT! I might even call in advance, state you have a restraining order with the exception of exchanging the children and that your ex has taken advantage of this in the past. Calling them with background may make the police more able to ensure having a "body" free to be with you outside.

WISHING YOU THE ABSOLUTE BEST IN THIS LESS THAN IDEAL SITUATION!!!!!

Home! They gave me 2 cops for the exchange! He kept trying to talk to me and the cops told him to back off. I'm so relieved. Our contempt hearing is the 20th and he may be going to jail. I need a good nights sleep. Thank you all so, so much for the support. I can't say anything in real life because people think its insane drama and I have lost a lot of friends over it. I'm thankful for you all.

I'm so glad they did that. And so glad your kids are home safe! So glad that even though the reason is that he doesn't want to be inconvenienced by your ex any more, the judge is putting a stop to your ex's silly "emergency" hearings that are a source of stress to you. (I'd wondered when the judge would tire of that - even if he does support abusive men!) I hope your ex does go to jail - at any rate the hearing will be mighty uncomfortable to him - and he won't be able to create his dramas quite so easily now. You're getting through it!

Thanks, yes we did. It was for contempt for him not paying child support ever. Apparently he gets the right to face me in person because it is a criminal hearing. The judge denied hearing me telephonically so we had to withdraw it. So my ex continues to get away with breaking court orders. We did file sanction charges for the court hearings he never attended. I think that is in October. He told the kids he will get them for Christmas break.

will you be rescheduling the contempt hearing? Why do you not want to face him in person?

I live 1200 miles away from him and the court hearings. I'm a full time worker and a full time student single handedly raising several children with zero financial support. I have a lawyer that goes to all hearings. It isn't very feasible for me to travel there for a hearing. Time, money and children just won't allow it.

ohhhh (sorry). I wonder why you need to be there and not just have a representative there. Can you get the hearings moved to where you and the children reside?

In a criminal proceeding, the defendant has the right to face his accuser. It's a constitutional right, so its hard to avoid.

It sounds like, in order to be taken seriously by this very crazy judge, you will need to find a way to get there for a court date. OR maybe you can move the jurisdiction since the kids reside with you- that would make a lot more sense to me...
