Has anyone actually done this and had the amount raised? I've been divorced April 2012 and haven't had a review done. I'm hesitant to as I have no clue how much ex earns now, though he used to get major bonuses and pay raises every year. Any words of btdt?
yes, i did. I was getting 1129$ per month. I filed the paperwork myself after my ex told me his pay drastically increased. We settled out of court with the help of his lawyer. I get 2000$ per month now. It was relatively painless, the most pain was from not filing sooner, I missed out on 1 year of increased support because i did not act as soon as my ex told me about the increase.
He has them tuesdays 9 am to wednesday 8 am and fridays 6pm to saturday 9am.
he doesn't get them much extra like the holiday schedule cause he works a ton.
We are supposed to disclose w2's every year, and he did tell me verbally I just took a long time to get the increase (about 9 months from when I thought about it to actually filing at courthouse)
Technically I could get more but I didn't want to drag it out or go to court about it as the amount is based on me having alimony and it ended in October.
Wow Crunchy, that's almost unheard of that an xh would voluntarily disclose a significant pay increase. He must actually have a conscience and that would explain why it went smoothly! A personality-disordered xh would do everything to hide income and then retaliate. Hillymum, I don't know your situation well enough to guess what will happen. What's your gut say?
I'm concidering getting a court order forcing ex to produce pay stubs and tax returns, (this year and every year following for the next 6 years!) I've explained it in the private forum. He's been such a UAV that I am taking the gloves off and going for it!
My ex started complained (after seven years) that the support he was paying "wasn't fair", and to talk to our mediator about getting it changed. Well, this was a year after he lowered it, on his own (out of court) after our oldest graduated.
I called the mediator and he suggested filing for a review, since in our state we're allowed to review every three years. Well, I ended up getting MORE, not less. Ex was livid. The dumb thing is, I wouldn't have bothered doing it except he insisted.
I was angry because he'd lied to me for years, saying he was getting paycut after paycut, etc, and as it turned out, he was making 50% MORE than he even had in the past. So anyway, needless to say, I'll be doing the every-three-year review from now on.
I've never heard of exchanging tax returns yearly, though.
