WV non vax - Mothering Forums

Hi, I currently live on the state line, Ohio side. So, obviously, no vax issues even if we didn't homeschool. But we're looking to sell our house and downsize. Honestly, the housing options tend to be better on the WV side. To give you an idea, we could buy a house that is about the same as our current house for significantly less $$$ (30% cheaper).
However, I'm concerned about the stricter laws and regs in WV. They've really been cracking down, suspending or expelling kids for not having every single shot including boosters. This is an excerpt from State code 16-3-4: Any parent or guardian who refuses to permit his or her child to be immunized against diphtheria, polio, rubeola, rubella, tetanus and whooping cough, who cannot give satisfactory proof that the child or person has been immunized against diphtheria, polio, rubeola, rubella, tetanus and whooping cough previously, or a certificate from a reputable physician showing that immunization for any or all is impossible or improper, or sufficient reason why any or all immunizations should not be done, shall be guilty of a misdemeanor, and except as herein otherwise provided, shall, upon conviction, be punished by a fine of not less than ten nor more than fifty dollars for each offense. (re.dic.u.lous)
Now I do currently homeschool, so I'm not really woreied about attendance, but the wording says "school aged" children and it has been clarified by offiials that they mean that to include homeschoolers. No citation, sorry. Basically, I'm wondering if others out there have info about this. Are they actually going after homeschoolers or would I be safe? Wondering if I have to rule out WV for housing options.
Btw, both sets of grandparents and our Dr are supportive/respectful so no worries about "calls" there.

From what I can find if you homeschool and do not vaccinate you are still guilty of a misdemeanor.

I guess the bill was passed to include homeschooled children in these requirements in 2004. 

 

 

I wouldn't live in WV or MS is you paid me!! I'm sorry for you in that it is clear living there would be cheaper for you. I just don't think a cheaper house is worth risking a misdemeanor charge!

In your shoes, I'd suck up the higher housing prices if it meant preserving my rights. You might consider writing to WV's governor, however. Let him/her know about your predicament and that you regretfully cannot live in that beautiful state because of its outmoded and draconian laws against informed consent. I'm sure that We the Parents could help you with some of the talking points.

Sigh. Ohio it is... What a shame. I think I will write Gov Tomblin. I grew up in WV and am not returning because of their vax laws: that's pretty sad.

Wow, I have to say that is not something I would expect to see in WV - I've always seen those states as much more open, but I guess that is not the case!  Sorry to hear about that.
