A small victory for the parents who have obviously suffered a great loss due to vaccine injury just has many others have.

http://www.uscfc.uscourts.gov/sites/default/files/CAMPBELL-SMITH.MOJABI-PROFFER.12.13.2012.pdf

Petitioners alleged that as a result of “all the vaccinations administered to [Ryan] from March 25,

2003, through February 22, 2005, and more specifically, measles-mumps-rubella (MMR)

vaccinations administered to him on December 19, 2003 and May 10, 2004,” Ryan

suffered “a severe and debilitating injury to his brain, described as Autism Spectrum

Disorder.

This seems pretty straightforward. His parents said he suffered a table injury (encephalopathy) within the required time frame, respondent agreed, they worked to find a reasonable payout.

Was there something in there about him being treated in Tehran?

And since they were awarded almost a million dollars I guess this puts the 250k max payout myth to rest.

Yes, his lawyer/parents were smart, they used encephalopathy rather than autism as the injury. Hopefully the parents of other children damaged by the MMR will take heed and file in the same way.

It also appears that as well as ASD, Ryan is suffering from asthma as a result of the neurological damage from the vaccines, as do many other vaccine damaged children.

Quote:

In the alternative, petitioners asserted that “as a cumulative result of his receipt of each and every vaccination between March 25, 2003

and February 22, 2005, Ryan has suffered . . . neuroimmunologically mediated dysfunctions in the form of asthma and ASD.”

I know a kiddo that sufferers a severe vaccine injury with encephalopathy. His payout was in the multi millions as he will need care for the rest of his life. So yeah, waaaay more than $250,000.

Yes. Parents whose children suffer a table event are foolish to file for something more controversial instead.

Post-encephalitic syndrome can manifest as ADS, so you would be very wise to table a condidtion that is actually recognized rather than a label if you want to be compensated for the damage done to your child by vaccines. This is why I hope parents of other vaccine damage children take note of this.

I've always heard 250k is the max you can get on a dead child, and that an injured child will typically be awarded much more as there are lifetime care factors to consider.

More information on Ryan and another child who won their case in this Huffington Post article and it highlights the lengths the government when to deny the claims:

Quote:

"I don't understand why they fought so hard," Moller [Emily's mother] said. "We had the evidence: the EEG, the MRI, everything was consistent with encephalopathy, post-vaccination. How can government attorneys claim what our doctors said happened, didn't happen?"

I was just going to post that HuffPo article. Still digesting all the information. Tragic. :(

That it's tragic I'm sure we can all agree with. The thought of a child being irreparably injured by vaccines breaks my heart, no matter how much, intellectually, I know children as a whole are better off.

"How can government attorneys claim what our doctors said happened, didn't happen?"

All the government wants to do is protect itself.

This is deliberately vague: I know someone who is suing the government in a sexual harassment case. This person was harassed, but the man who did it was very important in their department. I'm very involved with her case info, and I've even read the entire affidavit and witness testimonies. There are witnesses whose initial testimonies don't match their current testimonies--meaning, they have since changed their stories and are now lying. Why? Well, for one, they still have to work there, and it must be difficult for them to "rat out" their superior, so they just changed their testimonies.

Also, I know people who work in law enforcement, and let's just say there's a lot the public does not know. Stories of corruption from people who see it firsthand. Maybe that's why I'm so darn skeptical when it comes to the government and drug companies. I tend to trust the whistleblowers over the people who would rather lie and keep their jobs.

I agree.  If they would just wait until their little bodies and brains were bigger and more developed, so many of these tragedies could be avoided.  And all the preservatives don't help either.

So much heartache.  No amount of money can fix it.  The fact that they are acknowledging that the vaccines were at fault would mean so much more to me if I were the parent here.
