I can't believe it.  My heart is in my stomach... I can't stop crying because I feel so violated.  These are my children and who are they to question my beliefs?  :-(

 

I even reached out to a lawyer, to assist us in writing our letter, to make sure that we included everything that they may need... Now I have to wait until Monday to make phone calls to appeal.  I seriously feel as if someone has died.

 

Has anyone been through this process?

Mama to 9 so far:Mother of Joey (20), Dominick (13), Abigail (11), Angelo (8), Mylee (6), Delainey (3), Colton (2) and Baby 8 and Baby 9 coming sometime in July 2013.   If evolution were true, mothers would have three arms!

I'm so sorry.  I have not been through that process, I just wanted to give you some support and hugs.

 

Is there an appeals process?  What does your lawyer say?  Was this a philosophical or religious exemption?

 

I wonder, has anyone ever gotten the ACLU involved?

I would definitely file an appeal or call up the department, ask to meet with someone and problem solve how you can make this work.

 

It has been my experience in life than many "no's" can be turned into "yes" - you just need to figure out how to go about doing it.  

 

Good luck!  I can understand you feeling that your parental choice is being challenged.

It says you have about 10 days to file an appeal, and there is even some instructions on how to do so.  There is a phonoe number as well.

Thanks to all.  I had really hoped that having a lawyer involved, there would be no problems.  So, yes,I will have to appeal.

Make sure you get advice from your lawyer before you go to your interview.  Even if you don't belong to a specific church or synagogue, you might want to contact whichever one you grew up in (if any) or feel comfortable in (if any) and speak to the minister, priest, or rabbi about your religious/spiritual convictions and how they relate to your view of vaccines.  If they are supportive, you can ask them to accompany you to your meeting.  Your lawyer should accompany you as well.

Bad news, Davisam. This reeks of a "sincerity test," a kangaroo court session in which government attorneys who aren't even experts on religion and spirituality try to thought police your motives by grilling and drilling you to "make sure" you're not making your vax decisions based on safety concerns or other "secular" reasons. (Apparently God doesn't care about your children's safety; that's just "secular" eyesroll.gif)

Your choices are 1. Move. Neighboring Ohio has philosophical exemptions. It's also teeming with infectious disease as a result. Ohioans entering New York must first undergo a mandatory week-long quarantine at the border crossing. (Those last two sentences were sarcastic thumb.gif). 2. Homeschool. Moms in the Homeschooling forum can help you brainstorm a way to make that work. Even low-income, duel-income families, and single-parent families can homeschool. 3. Attend the Sincerity Test with your attorney and a video recording device.

If you are in or near NYC, keep in mind that schools are fined for each exemption. (I read this in some law journal. I can't remember which and hopefully that's no longer the case!) If this law is still in effect, they have every incentive to see that your children are forcibly injected.

Finally, look up that woman on Long Island. Mamas, help me out. Where's that video of her "sincerity" test? If you watch that video, you'll know I'm not exaggerating. I really wish I had better news for you. greensad.gif

As an interesting aside, some Libertarians at George Mason University ranked all states from the freest to the least free. NYS came in dead last.

Very sorry to hear this. My letter was just approved in New York State but it was approved in Massena NY.
