IL Law - Xfering out of Public to Homeschool

Hi all,

Can someone please help me out? I am pulling my DD1 (7, first grade) out of public school for the remainder of the school year. She is currently struggling with some social anxiety issues that are impacting her ability to learn.

Anyways... I have found this on the Chicago Public School website:

On that page it says that the following need to be completed and faxed to Chicago Public Schools:

  1. CPS Statement of Assurance Form
  2. A letter to CPS which describes the manner in which you will be instructing your child at home
  3. A copy of the Illinois State Board of Education (ISBE) Home Schooling Registration Form that is mailed to ISBE

And the ISBE Home Schooling Registration Form must be sent to the Illinois State Board of Education... http://www.isbe.net/research/htmls/home_school.htm

My question is - can I just pull her out and tell them my intent to homeschool, or do I have to register with the board of Education?

Anyone ever dealt with this before?

IL is weird. Do you want to know what your legal obligations are or the easiest course of action? Because full co-operation with what they ask may be the way of least resistance. Legally you don't have to do anything, they don't have any laws on the books. Yours counts as a home based private school, exempt from requirements and not eligible for registration. A law does say they can't legally call you negligent for keeping your child home. According to legal precedent "Parents must "in good faith" provide an "adequate course of instruction" in the prescribed branches of learning." You would in any case let them know not to expect her to show up because she's switched so they don't go after you for truancy/absences.

Sounds like homeschooling there is a very sticky issue, with misinformed school districts and poorly defined laws and procedures. Joining HSLDA might be useful where you are. Here is their legal analysis http://www.hslda.org/laws/analysis/Illinois.pdf

Actually, what that page says is, "The Chicago Public Schools (CPS) request that parents or guardians who choose to homeschool their children provide the following documents". *Request*. There's a pretty huge difference between "need to be completed" and a request.
