ABA: Bush violating Constitution

Quote:
Bar association president says signing statements erode democracy

WASHINGTON (AP) -- President Bush's penchant for writing exceptions to laws he has just signed violates the Constitution, an American Bar Association task force says in a report highly critical of the practice.

I can't believe that we have 2 1/2 years left before someone else is sworn onto office. How is it exactly that he is above the law???

"This report raises serious concerns crucial to the survival of our democracy," said the ABA's president, Michael Greco. "If left unchecked, the president's practice does grave harm to the separation of powers doctrine, and the system of checks and balances that have sustained our democracy for more than two centuries."

I'm glad somebody "official" is finally recognizing this!!

That's much more useful than ABBA writing a song about it!

It's about fricken time! Now would the old-school republicans please raise from the dead and take back that which has become of their once great party!?!? I just can't see the democrats reeling this abuse of power in since they haven't done it yet. It looks like it is going to have to come from within. God willing, there's enough of them to take back control. Go Specter, Barr and Dean!

Good piece in the Boston Globe today by the author of the aritcle that triggered the 'signing statements' hubbub:

"The bipartisan panel of legal specialists includes a former FBI director, a former federal appeals court chief judge, former Republican officials, and leading scholars.

"The panel said presidents do not have the authority to declare that sections of the bills they sign are unconstitutional, and that they thus need not be enforced as Congress wrote them."

This could get very interesting...

Specter prepping bill to sue Bush

"A powerful Republican committee chairman who has led the fight against President Bush's signing statements said Monday he would have a bill ready by the end of the week allowing Congress to sue him in federal court.

"We will submit legislation to the United States Senate which will...authorize the Congress to undertake judicial review of those signing statements with the view to having the president's acts declared unconstitutional," Judiciary Committee Chairman Arlen Specter, R-Pa., said on the Senate floor.

"Specter's announcement came the same day that an American Bar Association task force concluded that by attaching conditions to legislation, the president has sidestepped his constitutional duty to either sign a bill, veto it, or take no action."

The ABA has not only declared that his signing statements are unconstitutional, but also the wiretaping. Funny, that this highly reguarded, bipartisan organization comes to these conclutions, and we dont EVER here about it...but we sure heard a lot about Clintons BJs!!!
By the way...thank you to Ed Schultz for MY news!

Hm. That could take care of the standing dilemma, but I wonder how that's going to gel with presidential immunity.

Will definitely be interesting.

In my opinion there was some suspicious happenings in the 2000 presidential elections...and in my opinion Gore was elected and Bush was put there. The events since then seen to support my hypothesis. I don't understand how some Americans justify it within themselves to support a president who doesn't even follow the laws of his own nation.
