I am wondering about something. My dh is circumcised and it has caused him a lot of grief. He has sexual problems (not enough sensitivity, goes numb) and obviously some psychological issues relating to it-he is VERY anti-circ and goes on a rant whenever it is mentioned (go dh!).
Here is the thing-besides all of this other stuff, dh was never supposed to be circumcised. His mom and dad had decided they didnt want it done and the OB knew that. Right after she delivered him, they gave her a stack of papers and in it was a circ paper. She signed, not realizing. Then they came in and said they needed to take him to the nursery. Next thing she knew he was screaming from down the hall and they brought him back with a bandage on his penis and instructions on caring for the circumcision. Obviously the doc and anyone else involved KNEW that they didnt want it done, otherwise they wouldnt have said that they just needed to take him to the nursery and did it then.
Do you think my dh would have a good stance for filing a lawsuit? He was born in 1981 (is 25 now) if that makes any difference.

Thats kind of what I am worried about. I mean, he didnt know anything was even wrong until I told him that it wasnt normal and he looked into more. We also didnt know about his parents not wanting it done and all of that until last year. He just knew his mom hated it and didnt get his brothers done.
Who would I contact about suing? Should I try and find a lawyer to work probono (sp?) or file on our own? I have no clue...

Dave could tell you (Dave2GA, I think) but I believe in most states it would have had to been filed either before he was 3, by his parents, or when he was between 18 and 21, by himself. Worth looking into, though!

I don't understand these statute of limitations. I mean, what if a guy has horrible problems with his circ all his life and doesn't realize it's from his circ until he's, say, 30. And when he asks his parents why they did it and they say it wasn't supposed to be done at all and the doctor did it behind their backs, but they didn't pursue it because they just wanted to put it behind them, are you telling me this guy has NO recourse? I mean, limitations or not, wouldn't he at least be able to get his case heard? What if the problems don't show up until he's 22? Are "statute of limitations" laws (or whateve they are) set in stone? Can they be contested? I mean, life doesn't exactly run on a schedule.

This pisses me off. If I'd been circ'ed at age 6 for labial adhesions or something and JUST found out and it was causing problems, I'd wanna be able to do something about it. Of course, as a woman, I WOULD be able to cuz, ya know, female circ is just sooo much more horrible.

In ways, talking of adults suing for their circ complication I think if the limitation to sue the circumciser as an adult should be acceptable once he 'finds out what he lost' and the complications that 'resulted from it,

Because how many parents as in men don't find out what they are fully missing or fully understand that circumcision caused complications until their wife is pg with a son ?

I know that for some crimes, the victim has a certain period (years) after they turn 18 OR after they realize what was done.

I think your husband has a good chance of having his suit heard. Talk to Dave2GA.

I have talked to the ARC attorney (SS). The SOL is 1 year from the time you turn 18 to sue your circumcisor. PERIOD. For parents, I think it might be 1-2 yrs after the circ.

That's right. That's why infant circumcision is called the
perfect crime. By the time the circ'd man gets hip to what was done to him without his consent...it is usually too late to prosecute.
The trail has gone cold.

It will take a super hip, in-the-know, not to mention rich, 18 year old to file his circ suit. Both David and Steven are waiting his arrival...kinda like a messiah.

I'm glad his parents are logical and didn't do a STUPID thing by getting his younger brothers done. It wasn't their fault back then they put circumcision consent tucked in w/ all the other documents you need to sign when you have a baby. Fortunately, that's probably all but changed.

I think the statue of limitation has passed (one year after you turn 18 max.), but I think that's unfair! Not everyone realizes what was done to them before 18 or the year they are 18.

It is unfair. My dh was still a virgin until he met me, when he was 20. He had no clue that he would have problems with sex. It wasnt until I said something about his going completely numb during sex and being unable to finish not being normal that he realised something wasnt right. Fortunately he has always been against RIC though and was quite happy when he found out my son (he was 18 months old when we met) was intact
