Advice: ebay problem...

I don't know if this is the right place to post, but I need some advice. I purchased a NIB vintage juicer for dd#1 from ebay. I received it yesterday and found a crack in the strainer. I contacted the seller and his attitude is: oh its no big deal - he would refund me but I would have to pay for the shipment back. I emailed him again saying that he either misrepresented the item (and he should pay for shipment back to him) or it was damaged in transit (I paid for insurance, but he said that I should deal with UPS). His response is, please don't waste my time and that it is clearly stated in the description that if the item is misrepresented that the buyer is responsible for the shipping fee. I re-read his description, and that is true. The thing is, if you have a clause like that in your description, the seller can misrepresent his items and the buyer gets dinged.
Anyways, I'm really not sure what to do. I can keep the juicer, but I'm afraid a piece of the strainer might break off and dd#1 will drink it in the juice. Please help... what would you do?

If it were me, I would attempt to get my money back via ups if you paid for their insurance, and to heck with spending the extra to send it back to the seller. (although I think ins. usually covers what the item was worth before shipping) So you're out a little bit but not double the little bit, kwim? HTH and good luck!

I would also go through UPS, but try to find some value assessment, or go in prepared to tell them replacement cost. Especially since it's NIB. They don't need to know that you bought it on ebay, nor exactly how much you paid. I would think that it works like replacement cost -- if you can prove its value, I think they'll pay.
Hmm... I'm not sure how I can assess the value since the juicer is vintage (30-40 years old). New in a very old box! The value of the juicer is only $6, but I paid $10 shipping (including insurance). How can I tell if the seller really purchased insurance? I didn't see any special sticker on the box.

It is not really a matter of what he SAYS.
But I do believe he SHOULD pay shipping back, but does not have too. You could file fraud reports against him. Disclaimers mean nothing usually. It is in the seller's best interest to solve all problems, but some do not believe in CS. Go through insurance though--but if it was not damaged in shipment, would they cover it?

I wish I knew more links for you, but this is a start. Good luck. I got stiffed on some dipes from a WAHM and was appalled some sellers are so obnoxious and non customer service orientated.

Thanks Meco for the links. I found some useful info there. I did pay with my credit card via Paypal, but I'm not sure if I can do a chargeback since the seller did offer a refund minus shipping. I'll post a question on that board when the kiddos go to sleep. Thanks again! Its just such a hassle, but a part of me hates taken advantage of. BTW, I don't think the juicer was damaged in the mail. The seller either overlooked the crack or was dishonest.
