What can I do? My DD, age 7, just told me last Friday when her dad picked her up from her gymnastics class, he left before it was over and said he was going to grandmas. He came back an hour later and then took her to his apartment. Later DD heard ex and girlfriend arguing and crying about him smelling like beer and him telling her he had gone to the bar. DD was upset her dad lied to her about going to grandmas. I'm upset he went to the bar and still smelled like beer 2 hours later. He has a big history of drinking and crashing cars. He is currently on probation for assaulting me. He is supposed to visit with her tomorrow. We just got the divorced finalized less than a month ago. I'm so worried he will get in an accident with DD in the car and plus he doesn't even have a booster even thought that'<img alt="" class="inlineimg" src="http://www.mothering.com/discussions/images/smilies/bigeyes.gif" style="border:0px solid;" title="bigeyes">s the law here now. Any suggestions?

If he has a history of DUIs and arrests, then it stands to reason that he shouldn't be allowed to take your DD for visitation if he shows up intoxicated. What was written in your custody agreement?<br><br>
I indicated in mine that my STBX isn't allowed to consume alcohol or drugs 12 hours prior to the visitation, as well as during the visitation.<br><br>
Sounds like you need to speak to a lawyer about your legal recourse to enforce sobriety while he has your DD with him...refusing visitation can be a dangerous thing...

Document, call your lawyer and perhaps call the local police & ask if anything can be done re: the no booster seat, at the minimum.

If he smells like alcohol don't let her go and call the police, if he doesn't have a booster she can't go with him until he gets one. Call the police to document if you have to. I would trust my instinct and worry about the legality of it in the immediate moment.

I would get a rule instated that he is not allowed to drive with my dd in the car, i would also buy an extra booster for my dd to put in his car.<br><br>

Also...though this makes you the Booze Police, you could buy some of those at-home breathalizer tests and make him take one before he takes your DD with him. If he's over the limit, no visit. But again, this is definitely something you need to discuss with a lawyer and have instated in your custody agreement.
