Agnes Gereb, was arrested and jailed in Budapest, Hungary after a
woman unexpectedly went into an early precipitous labor and delivered
in her birth center. Agnes called the ambulance immediately and both
mother and baby were transported to the hospital. Home birth is
women's guaranteed constitutional right in Hungary but over the years
authorities introduced increasing restrictions for midwives,
essentially illegalizing out-of-hospital birth assistance. Agnes is in
a maximum security pre-trial prison held without bail. She faces five
years of confinement if convicted. Four more midwives are on trial.
The Hungarian Government has decided to retract the restrictions and
to legalize out-of-hospital birth assistance. The Department of Health
is working hard to draft the new protocols with the involvement of
home birth midwives. This is a much welcomed change after 22 years of
struggle to achieve this goal. However, the criminal cases are
continuing against all accused midwives.
