at a date unknown one of my stbx's brothers took out a credit card in my husbands name and proceeded to run up a $500 bill they never bothered paying.

and in order to get it taken off his record he has to call the credit card company and get EVERYTHING they have on his file and he has to call the collection agency and get everythign THEY have on him and THEN he can call them back.

Because of course i'm not stressed enough and i don't have enough to deal with! now i'm worried they are going to take our tax refund to pay off this debt that isn't even ours!

and that explains the mysterious credit card debt that kept us from getting a loan on the house we tried to buy late last year.
Oh, how maddening! Hopefully he will get it cleared up ASAP -- and hopefully your tax refund won't have to go to paying it off!

That's theft (identity theft?). Personally, family or not I'd be calling the police on said brother. Sorry, but if any family member screwed me like that I would have no sympathy (mainly because if anyone needed money all they would have to do is ask and I'd give them anything I could spare). I definately don't think you guys should have to pay it. Does STBX's brother know that you guys know? Is he willing to fork over the money to pay it? I guess I'd be asking him that first, if he says he's not going to pay it then I'd be going to the police with it.

(On a side note ex's sister was actually in jail last year for something eerily similar. She spent 90 days in jail. She should have been in longer but ex wouldn't tell the cops that she also stole his checkbook, forged his signature, and spent a couple hundred of his money)

That's horrible.

I agree with Steph that I'd be considering having him face what he's done. You should not have to pay for his bad decision.
stbx called police and he has to PROVE that he didn't get the card and didn't buy any of the stuff that ran up the bill.

i'm steamed. mainly because I still love stbx and he really doesn't need more stress. he has trouble handling normal stress levels much less this load of crap.

we're not sure exactly which brother did it. they live accross the state but one lived there for years and the other one only lived there for a few months so i dunno. I know one of them used to regularly give R's name out when he got stopped when he wasn't supposed to be driving. I discovered 2 speeding tickets (luckily just warnings) when me and R were together sans vehicle. I was quite confused until Robert confessed.

now we're going to have to get a copy of his credit report and make sure that's the only thing he did with stbx's ssn. ugh i can't believe his own family would do this! and these are the people he chose over me

What is the address the card was mailed to? Wouldn't that show which brother ordered the card? Ask the credit card company if they will put all the charges in dispute while the matter is being resolved. Call the credit bureaus Experian, Transunion, and Equifax and have a fraud alert placed on each credit report. That way you will not be held liable for future purchases. They may even notify you before any future credit can be taken out in your name. Get the police involved. Ask for copies of transactions from the credit card companies, they should be able to provide you with dates and locations.

Sorry mama, that is awful. I don't think they can intercept your tax refund. My ex had a credit card bill that he didn't pay for 5 years ($400 balance) and they never intercepted a refund of his, they just put it on his credit report.

I don't know i'm really upset right now and i honestly think he deserves it b/cuz he knew about Robert using his name and never filed a complaint at all.
I agree w/ Jillian. I've had a $3000 debt from one credit card for almost 7 years and they've never gone after a refund or even pay garneshment. (Long story, and yes, I do intend to pay it - I've carried around the bills for almost a decade.)

I've heard it has to be like $5,000 or $10,000 before they really go after you.

In a case of identity theft, can you get a new ssn? I know it'd be a pain to change out everything that uses the ssn, but it's better than having the number in the hands of a completely untrustworthy person.
Since they lived in the same house it is going to be VERY hard to prove that his brother made the charges. Unless you can find out what he charged and have a police officer search his house and find the items. You might want to have ex call a lawyer and get legal advice. BUT, it's really not your problem mama. So don't stress yourself out over it. Make sure the credit card debt is not included as communal marriage debt in court, and it shouldn't be if it is under investigation.
no the two brothers lived in the same house with each other. my husband has never lived there.

and yes it IS my problem because we are still married.
