You're right, that was definitely a cry for help. No one with any sense could ever dream of that being acceptable. The thing is though, is there anything we can do? Write or call the police station and insist that she be given a complete psychiatric check up? It seems so obvious that she's in need of something, be it medical treatment or counseling. Yet, I bet this is just another case that will fall through the cracks, and 5 years from now she'll be back in the news as a child abuser. <img alt="" class="inlineimg" src="http://www.mothering.com/discussions/images/smilies/greensad.gif" style="border:0px solid;" title="greensad"><br><br>

Obviously there is something wrong with this woman, but she didn't assault anybody. They charged her with the wrong thing. "Assault" is defined as a physical attack on one's person. Anything else and you are really stretching it. What this woman needs is a mental evaluation/treatment, not jail time.

Actually, assault can be the threat of violence. Per <a href="http://dictionary.reference.com/browse/assault" target="_blank">dictionary.com</a><br><br>
1. a sudden, violent attack; onslaught: an assault on tradition.<br>
2. Law. an unlawful physical attack upon another; an attempt or offer to do violence to another, with or without battery, as by holding a stone or club in a threatening manner....<br><br>
1. A violent physical or verbal attack...<br>
2. c. An unlawful threat or attempt to do bodily injury to another....<br><br><b>2. a threatened or attempted physical attack by someone who appears to be able to cause bodily harm if not stopped</b><br>

I agree that the woman probably needs mental treatment, but can they compel her to attend if she is not arrested? Or is that the only way to get the ball rolling, so to speak? Or what if she is just mean? Not everyone that does something cruel or stupid is mentally ill.

Battery is the attack, assault can be the threat of violence.
