This is in Long Island NY at a suffolk county library

Attention:

Public Library Discriminates against Mother with Hungry Baby

They will not be moved and they refuse to cover up their nursing babies.

On August 16, 2006 at 10:00am, a group of concerned moms will protest at the Longwood Public Library located in Middle Island, N.Y. in an effort to have their legal rights recognized by staff members and the Suffolk County library system as a whole.

The Nurse-in was prompted by an incident that happened earlier in the summer when a mom was asked to leave a children's program to go elsewhere and nurse her 10 month old daughter. She refused and finished watching the program. When she brought the incident to the attention of the library's director, she was met with threats, hostility, and a blatant disregard for her legal rights.

On Friday June 30, 2006, Keri B. Neary-Wood and Kristen Ferrara were attending a children's program, at the Longwood Public Library . During the program Neary-Wood was interrupted by a library staff member and asked to cover up her nursing infant. When Neary-wood said no, she was asked to use a quiet room downstairs because another patron had complained. In an effort to educate the staff member, Neary-Wood informed her of New York State law § 79-E. Right To Breast Feed, which states that,
Notwithstanding any other provision of law, a mother may breast feed her
baby in any location, public or private, where the mother is otherwise authorized to be, irrespective of whether or not the nipple of the mother's breast is covered during or incidental to the breast feeding. NY CLS Civ R § 79-e (Article 7 Miscellaneous Provisions). 1994 N.Y. ALS 98; 1994 N.Y. LAWS 98; 1994 N.Y. S.N. 3999

Following the Children's Program, this incident was brought to the attention of library director, Mr. Clemens, by Neary-Wood and Ferrara in an effort to educate the library staff of Nursing Mothers' Legal rights. When told of the Law, Clemens responded by stating, "We don't have to listen [to the law]. We have to be considerate of all people here and if people are complaining [about you nursing], then we can tell you to leave."

All major health organizations, including the American Academy of Pediatrics, the World Health Organization and UNICEF agree that Breastfeeding is the healthiest way to nurture a child. However, the nursing rates in the United States fall far below the goals set by Healthy People 2010. One of the leading reasons why more women don't breastfeed is the lack of societal support in our culture.

) I am just so ashamed of how ignorant that is.

Since when are libraries exempt from obeying state law? That's like kicking out a black person and saying "We don't have to listen to the law. We're above it! If someone complains, we can do what we want to make them comfortable no matter what the law says! It doesn't apply to us, the almighty library!"

I'd love to see what the committee who supplies their funding has to say about the fact that the library feels they are exempt from obeying the law.....how arrogant.

Ugh!! I wish I could be there for that. That makes me so mad. I'm so proud of that mama for sticking to her guns. I think what bothers me most about this incident isn't even the original attempt to get the mom to cover up (even though that does frustrate me), it's the response to the actual laws that angers me. What arrogance. Think he would mind if people stole books from the library? I mean hey, who cares about the law.

WOW - I'm really tempted to post this on all the library email lists I'm on. I can't believe that he said that. (I had to self edit out the names...) It's so unprofessional & I hope he gets a rude awakening.

Sheesh. Someone wasn't paying attention in library school. DUH!

Exactly! what was her3 yo supposed to do?? Miss the program? or sit there by herself?

Doesn't the NY law have some teeth, as in specified consequences if someone violates it? I seem to recall that it is unique in that respect.

I hope they file a formal complaint to prove to that unprofessional jerk of a head librarian that YES, You Do Have To Follow The Law.

Besides which, what about the nursing moms' comfort? sounds like he's pretty selective about whose comfort he's willing to lood out for.

I never seem to understand this. Why don't nursing mothers matter as customers, patrons, guests? Seriously, it's like the minute the mom goes to nurse her baby she suddenly becomes this undesirable that is offending all of the REAL customers, patrons and guests.

Please, please keep us posted on how this turns out! I'm trying to keep track of incidents like these that we can show our lawmakers here in WI where we have next to NO bfing laws (only the lame exempt from criminal behavior one...thanks, Tommy Thompson.)

I really like this NY law b/c it includes the incidental nipplage language. People are very into "discreet" nursing around here (discreet being very open to individ. interpretation).

So, does anyone know if there are any "teeth" to this law? i.e. consequences to not abiding by the law?

The press release didn't say but they (the moms who confronted the director) told me he actually said "this isn't a public place"!! what a moron right? It's a flippin PUBLIC library.

Long Island is so hurting for a wake up call as far as NIPing is concerned. Even though we are right next to one of the biggest cities, it is like a whole other world out here.

Not ONE birthing center, like 4 home birth midwives for a population of more than 4 million people (not including queens county) We lead the nation in elective c- sections. If you give birth in a suffolk county hospital, you have a 36% chance of getting a c-section!

The only breastfeeding mothers I have ever seen here are my friends and one woman when I was a kid in the 70's, she was a hippy who traveled the country with her hubby in a station wagon with tipi's painted on it.

The woman who was asked to move told clemens (the director) that she would inform him of the law, she also wrote the board of trustees.

His response was that he didn't remeber things said that way - not a single ounce of remorse or even a hint of an apology, even after reading the law. As for the trustees, it was the same old lame " we are breasfeeding friendly" crap, barely choked out an apology.

Totaly unacceptable.

I think a sign in EVERY public library in suffolk county stating the law and that bfing mothers and their children are welcome - in plane sight would be a better response.

Any suggestions on how to make this a success would be appreciated. Thje word is getting around but we need more help.

Come on Mama's I know you have some ideas.

Our library is super breastfeeding friendly. They have big floofy chairs and sofas in the children's wing, they let our LLL group do a display for WBW, they display pamphlets for LLL in the family room, etc, etc, etc.

I think you should all go en masse and breastfeed anyway, not as a protest, but as a "Thank you for being breastfeeding friendly" gesture. Since, you know, they say they are.
