Brief history- X left in December, would see the kids once every week or two. Basically absent in my opinion considering he lives about 3 miles away. In March he took the kids on one overnight to his apartment. Then this weekend and last, he took the kids one night. So we're talking 3 nights in 8 months. He tells me today when he returned the kids that he wants joint physical sutody. This is after harassing me for months about the divorce settlement to the point of exhaustion. I finally signed a week ago under major duress! The settlement says "sole physical custody". Now it looks like he's going to have his attorney NOT file the agreement. What an ass! I gave birth to kids b/c I wanted them with me always. Now he sayd that he doesn't want the kids to say in later years that he "gave them up". UGH! He gave them up when he slept with 18 whores behind my back! I'm so pissed!

Umm. Joint physical is a stretch. He hasn't demonstrated a sustained interest in them. I would think he would get joint legal with visitation, conisdering the precedent he set throughout the divorce. I would def talk to my lawyer.

well that's what the divorce agreement says- joint legal, sole physical. But he could always sue for custody just to drive me nuts and kill my/my parents' bank accts. Yes, he's that mental!

Yes, but courts don't just change things because he requests it. My XH is totally insane. So, I so know where you are coming from on that one. In my area (Michigan), I was told that my XH would have to demonstrate a substantial change in circumstances for the court to change from sole to joint custody.

He could also be held responsible for court costs and your lawyer fees if he's doing things that are wasting the courts time just to get to you. Talk it over with your lawyer next time you see him.
