I just read that. I will admit to knowing NOTHING about the death penatly laws in the States but how can it be legal if the Supreme Court says it isn't? I don't agree with the death penalty but it especially doesn't seem right to execute someone who doesn't seem to know what they did wrong.

I live in Texas : I HATE the death penalty for anyone, especially the mentally challenged Sadly we are talking about a state where it's pretty much ok to kill anybody I will never understand it! During any given year we will allow domestic violence, admitted murders and rapists go free but once you're convicted they can't wait to kill you no matter what your mental capacity.

I believe that the argument is that severely mentally retarded is different from mentally ill. I agree with that. They are two separate disabilities.
I don't believe that people with severe mental illness should get the death penalty, however. Hallucinations and delusions create a separate reality for people with severe mental illness. Perceptions are seriously skewed. People in the midst of a psychotic episode are frequently unable to determine right from wrong. How can they be held accountable for their actions? How can we kill them, when what they need is decent mental health care? Oh, wait.. that's right! It's easier to throw them into jail and kill them than to get them actual treatment for their diseases!
Look for this kind of thing to increase in frequency, unless the Supreme Court rules directly against it. More and more people with severe mental illness are finding themselves incarcerated, as psychiatric hospitals close down throughout the U.S.
Look out your window. We are, indeed, in the Dark Ages.

I agree.

Ya know, it is my belief that ANYONE who maims or kills another human being SHOULD be charged by reason of insanity. Anyone who is sick enough to commit an atrocious crime is so OBVIOUSLY ill.................................

I just don't understand our punitive-based justice system. The people that do heinous things need help. It's never worked. Never has, never will.
