Here's the part that confuses me:

Quote:
Mrs Brown said she then underwent complicated dilation and curettage treatment to get rid of the dead child, which involves scraping the uterus.
I know next to nothing about this process, but what exactly did they do there if the baby was (and is) still alive and well?

There was a mom on another board I'm on that this happened to. Something about there being a divide in the uterus (not normal) and when they did the D&C it didnt reach the baby whom they assumed was dead. Instead it was hiding in the second area of the uterus and fine. I dont rmeember the details but thats the gist of what I do remember.

There is a mom in my mothering.com due date club that was told she had a miscarriage around 8 weeks only to find out 10 weeks later a baby was alive and well...and she must have been carrying twins. I don't think she had a d and c though...

I think the term is bicornuate uterus, though there are other forms. It isn't entirely rare.

THis is tragic. I hope she sues them. How can you have faith in a medical system when there are so many tragedies going on everyday due to stupidity and laziness?

There are a number of moms on this board who have been told their baby has died, and have a later ultrasound which shows a living baby.

As someone mentioned, it could have been twins.

With the bicornate uterus....I'd think they'd have found that on a scan....

Strange...

A good thing that no physical harm (so far) has been done.

True. Uterus deformations are actually quite hard to find. It took me 4 months of tests, ultrasounds, hysterosalpingograms, D&C's, and MRIs for them to figure out I didn't have one. Ended up being a tumor.

How scary for that poor mom.
That was my thought too when I first read it.

Poor medical diagnostics? Telling her the baby was dead when it wasn't? Poor medical care? Undergoing surgery and anesthesia, both very risky, when it wasn't medically necessary because the doctor goofed?

Those are a few reasons to sue.

I prefer not to ponder that since I was told mine was dead/ or more to the point, just not there, and had a D&C two weeks later when I didn't naturally miscarry.
