I was just wondering which states are NIP-firnedly and which are not. Is there somewhere I can locate this? I am from AZ and we plan on going back there but with the NIP stuff that has been going on my Mom keeps telling me they will arrest me! (Not that I believe her and will whip my boob out anywhere if dc needs to nurse! <img alt="" class="inlineimg" src="http://www.mothering.com/discussions/images/smilies/winky.gif" style="border:0px solid;" title="Wink"> ) My Mom is anti-NIP (sigh...) but is she telling the truth?

Go to <a href="http://www.lalecheleague.org" target="_blank">www.lalecheleague.org</a> and click on their bf and the law section. I believe they have a state-by-state listing of laws affecting bf.

There are states that don't specifically protect breastfeeding by exempting it from the indecent exposure laws. But I don't think there is anywhere you would need to seriously fear being arrested. It is of course possible, if they were to interpret your NIP as breaking an existing law, but I think you could manage a situation without ending up arrested. If you were NIP in a state w/o bf legislation and encountered a problem, the best choice of action IMO, would be to simply comply with their request at that moment. You would certainly have the opportunity to communicate with the management of the establishment before the situation got to the point that anyone would call the police. (I doubt you need to worry that you'll be sitting there eating lunch NIP and have the police force swoop down on you without warning <img alt="" class="inlineimg" src="http://www.mothering.com/discussions/images/smilies/lol.gif" style="border:0px solid;" title="lol"> )Then you could come here and let us know and we'd swamp them with info and encouragement to adopt bf legislation, lol. Of course there are mamas already working on getting AZ to do so, and if I were going there I would not hesitate to NIP if I needed to.

I live in Chandler, AZ (where we just got the only BF ordinance in the state)!!! According to the city atty, there has NEVER been a prosecution of a nursing mom in the state for indecency, even though the law does not exempt BF from indecency. You DON'T have legal protection about being asked to leave, or go to the bathroom (except in Chandler), but we're working on it.<br><br>
In 19 mos, I have had one incident, which was very minor. A 60-something saleslady in a dept store suggested I would be comfortable in the lounge. I told her I was fine, that was the end of it.<br><br>
I wouldn't be overly concerned about AZ. You'll find isolated incidents of stupidity here, but you can find the same thing anywhere.

has all the laws. even though there are 38 states that have laws protecting breastfeeding, not all are regarding nip.

YOu can NIP in ALL STATES. It is NOT illegal anywhere. It happens to be specifically protected in 38 states, but that does not mean it's illegal in the rest.<br><br>
That's the one downside of these laws and why I think education rather than legislation for idiots* would have been a better way to go. Once you make a law specifically stating that something is legal and protected, that law can be changed to its opposite.<br><br>
*What I mean by "legislation for idiots" is that the laws were written because idiots were trying to stop moms from NIP based on indecency laws.
